Failed sterilisation - birth of fifth child - depression -

E's fourth child was to be delivered by caesarean section (her
third caesarean). At the same time, E expressed a wish that she be
sterilised. This plan was confirmed by her obstetrician and was
documented in her notes. The discharge summary sent to E's GP
confirmed that she had undergone a caesarean and sterilisation. In
fact, unbeknown to her, she had not been and E became pregnant
again, as a result of which she suffered from depression. Following
the birth of her fifth child, E was sterilised.
Hilary Barsey settled the claim in the sum of £15,000, plus
costs.
